Relaxation of the re-opening requirements for IT and ITeS companies.In furtherance to objections raised by the industry, the requirement of compulsory CCTV recording of the “workspace” and submission of the same to the Municipal Authority every fortnight has been done away with. The requirement to have CCTV recordings of common areas/cafeteria, etc., is still in force. These recordings should be made available to the authorities “as and when necessary”. The retention period has not been prescribed but we would recommend that the recording be retained for at least 30-45 days.

SEZ units: major rental incentive proposed.By means of this circular, the Government of India has informed all Development Commissioners (DC) of SEZs that a decision has been taken to (a) not increase lease rentals for the financial year 2020-21 and (b) permit deferred payment of lease rentals (for the months of April, May and June 2020) till July 31, 2020 without levy of any interest. The circular also requests DCs to advise private SEZ developers and co-developers to extend similar benefits to companies having units in private SEZs. Most IT and ITeS companies which are SEZ units have office space with private SEZ developers.

Uttar Pradesh temporary exemption from Certain labour laws Ordinance, 2020 (the "Ordinance"). The said Ordinance exempt all establishments, factories and businesses from the purview of all, but three labour laws and a section of another act. With this, the state will have three active laws -- Building and Other Construction Workers Act, 1996, Workmen Compensation Act, 1923, Bonded Labour Act, 1976 and Section 5 of the Payment of Wages Act, 1936. The Ordinance will come into effect only when it receives the presidential assent.
