Profile

Abhinav has over 18 years of experience in Litigation and Arbitrations. He started his practice with the Chambers of Hon’ble Ms. Justice (Retd) Indu Malhotra (at the time when she was a Senior Counsel) and gained valuable experience in handling prominent and big ticket matters before the Supreme Court and High Court of Delhi.

Before joining Kochhar & Co., Abhinav was heading the Disputes practice at a prominent law firms and has handled a wide variety of matters pertaining to commercial disputes, public Law, consumer cases, labour and employment, white collar crimes across various courts, forums and tribunals. Abhinav has worked extensively for many reputed clients, particularly in the infrastructure and aviation space. He has advised and represented clients in many high-profile and highly contentious matters and investigations relating to government contracts and tenders, debarment proceedings anti-money laundering proceedings and attachment of properties amongst others.

Some of his represented clients include large conglomerates, major infrastructure and real estate companies, key players in aviation, and leading organisations in the healthcare sector.

Select Experience Statement

  • Advised and represented a domestic airline (Spicejet) before the High Court of Delhi in a Writ Petition challenging the notifications issued by the Ministry of Labour and Employment, Government of India amending the Provident Fund Scheme in its application to International workers.
  • Advised and successfully represented a large bus manufacturing group (JBM) before the High Court of Delhi in its challenge to a debarment order issued by the Ministry of Heavy Industries, Government of India.
  • Advised and represented Bhakra Beas Management Board before the High court of Himachal Pradesh and the Supreme Court with respect to a dispute pertaining to legislative scope of State Legislature and Parliament under the Constitution of India and the powers and obligations of a Board constituted under a statutory enactment.
  • Advised and represented Emaar Properties before the High Court of Delhi and Appellate Tribunal, PMLA in attachment proceedings arising under the provisions of PMLA involving interpretations to various provisions of Prevention of Money Laundering Act, 2002.
  • Advised and represented Emaar India Limited in proceedings before the Adjudicating Authority under the Foreign Exchange Management Act, 1999 (FEMA) with respect to investigation and complaint filed by the Enforcement Directorate alleging non-compliance of certain regulations framed under the FEMA.
  • Advised and represented a company forming part of GMR Group before an Arbitral Tribunal and the High Court of Delhi with respect to disputes arising under a contract executed with NHAI for development and maintenance of a stretch of highway in the State of Andhra Pradesh.
  • Advised and represented Indian Oil Corporation Limited before the High Court of Delhi in a petition under Section 11 of the Arbitration and Conciliation Act, 1996 pertaining to a claim of over Rs. 8,000 crores arising under a Take or Pay obligation reflected under a Gas Supply Agreement.
  • Advised and represented a company incorporated in the Kingdom of Netherlands in an arbitration matter against the Government of Albania before the International Centre for Settlement of Investment Disputes (‘ICSID’) invoked in terms of Bilateral Investment Treaty between Albania and Netherlands. Dispute arises out of a contract for development of a Solar Power Project.
  • Advised and successfully represented Delhi International Airport Ltd. in a domestic arbitration proceeding in its dispute with Airport Authority of India regarding nature and treatment of Custom Duty Scrips issued by Government of India under Foreign Trade Policy.
  • Advised and represented an Indian subsidiary of a Chinese company, which was awarded a contract for construction of a Flu Gas Desulfurization Unit by the Gujarat State Electricity Corporation Limited, in an arbitration matter against a sub-contractor arising from Contract for construction of Pile Foundation work.
