Shiv is a seasoned litigator with over 17 years of experience and brings to the table a vast array of expertise in advising both multinational and domestic clients on various contentious and non-contentious matters, from a pragmatic and commercial perspective. He also provides counsel on issues emanating from general corporate aspects as part of his broader forte on commercial law advisory.

Shiv has extensively devoted himself to various vistas such as arbitration, insolvency and bankruptcy, commercial and contractual disputes. His skill set includes advising a broad spectrum of clients and handling litigations and arbitrations for various multinational firms and companies pertaining to hospitality, commercial negotiations, engineering contracts, SARFAESI, Mercantile Law, Criminal Law and Writ Jurisdiction, amongst others. His proficiency further extends to advising various multinational banks and financial institutes on commercial issues as well as litigation and insolvency aspects.

In his previous role, Shiv spent a notable 16 years as a Partner specializing in Arbitration, Disputes, and Insolvency Practices at a leading full-service law firm.

• Representing and advising a French multinational company engaged in the manufacture of noble gases in disputes against an Indian Public Sector Undertaking (PSU) in disputes pertaining to Engineering and Construction. Successfully defended the client before the Hon’ble High Court at Amravati pending adjudication of the disputes.
• Representing and advising a French multinational company engaged in the manufacture of noble gases in disputes against an Indian powerhouse engaged inter alia in the business of manufacturing Steel and copper. Successfully represented the client in various courts pending adjudication of said disputes.
• Representing and advising a leading 5-star hotel situated in New Delhi in several disputes against State functionaries. Further advising the Client on routine day-to-day affairs and operations pertaining to regulatory and compliance as well as corporate governance.
• Aiding and assisting a leading Indian entity engaged in the business of investments in securities in respect of injunction decrees passed against it by the court in proceedings initiated by the opposite party regarding unauthorized construction.
• Advised and assisted the Committee of Creditors as CoC Counsel consisting of several domestic and international banks and financial institutions in connection with the entire CIRP of a leading entity engaged in the business of shipping and dredging, from the date of constitution of the CoC until the submission of the Resolution Plans with a deal value of USD 178 million (approximately).
• Advising and successfully defending a leading healthcare company in insolvency proceedings initiated against it by the counterparty. The deal value is INR 51 crores.
• Advised a leading private equity firm in respect of advancing financial aid to an educational institute by way of Non-convertible Debentures to the tune of INR 51 Crores. The transaction involved an in-depth due-diligence (corporate as well as real estate). The mandate also included drafting of all instruments such as Debenture Trust Deed, Escrow Agreement, Share Pledge Agreement, Deed of Hypothecation, etc.
• Advising and assisting numerous international law firms and clients on aspects of enforceability of foreign judgments in India.
