Kochhar & Co. Advises EXIM Bank on Structuring Security for Overseas Investment Financing in Indonesia

Export-Import Bank of India (EXIM Bank) has sanctioned credit facilities to an Indonesian entity under their Overseas Investment Finance Programme of approximately USD 21 Million, for setting up a manufacturing unit in Indonesia.

Kochhar & Co. advised and assisted EXIM Bank in structuring the security package for the financing, including securities to be provided by the promoters and promoter entities in India, in accordance with the applicable foreign exchange regulations in India. The Firm provided end-to-end legal and regulatory support throughout the transaction, with particular focus on developing a security structure that was commercially effective for EXIM Bank while remaining compliant with the applicable laws in India. The Firm advised on the overall structuring of the security package, undertook the requisite legal and regulatory analysis, and drafted, reviewed and negotiated the transaction documents and assisted with completion of all pre-closing and post-closing formalities.
