Overview

Kochhar and Co. has extensive experience in advising clients, both domestic and international, on India law issues pertaining to the pharmaceutical sector. In particular, the Firm has advised a number of pharmaceutical companies in protection of intellectual property, acquisition of business and products, setting up manufacturing facilities in India, commercial tie-ups and arrangements, and in conducting research and development activities, including clinical trials, independently and/or in collaboration with Indian partners.

The Firm regularly advises on health care and life sciences regulations, including amongst others on licensing, import, registration, stocking, distribution and sale, price control, labelling and packaging requirements, ethical standards, medical devices, new drugs and clinical trials. Besides, the Firm also has substantial experience in advising clients on product liability issues, medical negligence related claims, product recalls, environmental pollution and remediation and risk mitigation. The Firm also advises clients on genetically engineered products, and health, safety and environmental issues.

The Firm has represented some of the largest companies from healthcare, pharmaceutical, medical devices and cosmetics sector in intellectual property related disputes, including in relation to patents and trademarks.

The Firm has also defended healthcare and pharma companies, professionals and executives in relation to proceedings both civil and criminal including those relating to medical negligence, human trials, allegations of non-compliance with the various regulations, fixation of ceiling price under the drugs prices control order.

In addition to the above, the Firm has represented special interest groups in the pharmaceuticals, health care and life sciences sector and brought to the attention of the regulators issues facing the sector leading to changes in legislations, rules and regulations.
