Profile

Rushil is a core member of the Firm’s Dispute Resolution team at its Mumbai office.

Rushil regularly advises on various civil/commercial disputes, involving litigation before Courts and arbitral tribunals, white collar crime and insolvency related proceedings. Rushil regularly advises, assists and represents clients before various judicial and quasi-judicial fora across the Indian jurisdiction. He is actively involved in drafting of pleadings and research on complex legal issues. As part of the Firm’s Disputes Resolution team, he has represented a wide range of clients across industries including real estate, insurance, projects & infrastructure, technology and finance.

He regularly represents creditors under the Insolvency regime before the National Company Law Tribunal as well as its Appellate Bench. Rushil has also advised multinational clients on the corporate insolvency process and on the development and implementation of a resolution plan under the Insolvency Code. Rushil is also actively involved in advising and representing creditors in the post insolvency commencement process, including representing them before the COC.

His practice includes advising clients from an advisory and strategic standpoint so as to agitate their case in a precise manner before the various fora.

Select Experience Statement

  • Advised an overseas alternative investment management company specialising in emerging markets, regarding certain important legal aspects of the resolution process as laid down under the Insolvency & Bankruptcy Code, 2016, with regard to a landmark insolvency resolution case.
  • Advised and represented one of the promoter-director of a leading software company in India, in an application of oppression and mismanagement under Section 241 read with Section 242 of the Companies Act, 2013 before the National Company Law Tribunal, Mumbai.
  • Advising and representing the world’s foremost daily newspapers focused on American business in criminal defamation proceedings initiated before a Criminal Court.
  • Advised and represented an insurance company in arbitration proceedings initiated by a re-insurer to seek recovery of a large sum of commission (under the obligatory cession regime) retained by the insurance company over and above the percentage prescribed.
  • Represented a multinational pharmaceutical company, having their offices worldwide, in a debt recovery proceeding filed by the Bank against the landlord of the company.
  • Represented a leading commercial real estate management firm in arbitration proceedings against a deemed university located across India with regard to its claims which arose under a PMC agreement in relation to the construction and upgradation of one of the university’s campus premises.
  • Representing an independent full-service advertisement agency for its claims against another advertisement agency for procuring services in the area of strategic planning, media relations, public affairs, strategic advice and public relations management for its clients.
  • Advising and representing a Japanese conglomerate in execution proceedings of an arbitral award before the Bombay High Court.
  • Represented a well-known multinational tour operator in proceedings relating to its challenge of a domestic Award passed against it in an international commercial arbitration.
