Raheel Kohli is a member of the Firm’s Dispute Resolution practice group.  He specializes in Dispute Resolution in the Infrastructure and Energy sector.

Raheel is a litigator who covers the entire spectrum of advisory, risk analysis and argues matters before Regulatory Commissions, Appellate Tribunal, State High Courts, and the Supreme Court of India.

Raheel has been regularly representing both companies and government institutions on varied sectoral issues arising out of Power Purchase Agreement, Transmission Service Agreement, Concession Agreement, Operation, Maintenance and Development Agreement, Gas Transmission Agreement and agreement based on Model Private Public Partnership and such related agreements issued by the concerned ministries of Government of India. Over the last few years, he has been associated with several precedent setting disputes pertaining to infrastructure projects.

Raheel has also represented clients in complex and high-stake arbitrations before the Arbitral Tribunal constituted under the contracts relating to development & commissioning of distribution network and transmission project.

In addition to his Energy practice, Raheel regularly handles complex commercial and civil matters for leading companies across sectors including information technology and infrastructure.

Select Experience Statement

  • Represented transmission licensee before Haryana Electricity Regulatory Commission, in relation to a transmission project executed under Public Private Partnership (PPP) model. The legal proceeding was initiated by a PPP partner, involving issues regarding availability and reliability of the transmission system.
  • Represented distribution licensees before various forums in matters relating to Open Access, Fuel Surcharge Adjustment, Advance Consumption Deposit, Peak Load Exemption Charge, Cross Subsidy Surcharge, tariff determination, dispute with builders/colonizers regarding development of adequate electrical infrastructure, billing disputes and other related issues.
  • Represented distribution licensee before the Punjab and Haryana High Court in a legal proceeding involving interpretation of provisions of the Haryana Development and Regulation of Urban Areas Act, 1975 and Electricity Act, 2003 with respect to responsibility of the builders/colonizers to develop electrical infrastructure while developing an area.
  • Represented a small hydro power generator before Appellate Tribunal for Electricity, in a legal proceeding initiated against distribution licensee, involving the issue regarding determination of project specific tariff instead of generic tariff.
  • Represented distribution licensee before Appellate Tribunal for Electricity, in a legal proceeding initiated by Indian Power Corporation Limited seeking grant of second electricity distribution licensee in the area of Gurgaon Municipal Corporation under the Electricity Act, 2003.
  • Represented distribution licensee before an arbitral tribunal in defending claims alleging unlawful termination of contract regarding segregation of rural domestic feeder from agricultural feeder.
  • Represented transmission licensee before an arbitral tribunal in defending a claim alleging delay in installation and commissioning of transmission system inter alia on account of force majeure.
  • Represented distribution licensee before an arbitral tribunal in defending claims alleging unlawful termination of contract regarding supply and installation of HT lines and augmentation of distribution system.
