Actor Vishal’s new release “MADHAA GAJA RAJA” under his banner Vishal Film Factory Stayed by Madras High Court

The Madras High Court on 5th September 2013 after hearing legal counsel briefed by Kochhar & Co. granted an interim injunction against the release of the Tamil movie “MADHAA GAJA RAJA” starring Actor Vishal.

The interim injunction was granted after Mr. Santhanam, resident of Australia, filed an injunction application inthe High Court of Madras on the 5th September 2013 through his Legal attorneys “Kochhar & Co, Chennai”. Mr. Santhanam in his claim statement filed in the court states that the original producers of the movie “Gemini films” had come to Australia for the shooting of the movie and after negotiations agreed to pay approx. AUD$ 90,000 (Rs. 60,00,000/-) for rendering his services in Australia. Mr. Santhanam provides complete facilities such as food, accommodation, costumes, production equipments, travel facilities for the production unit and film stars during their shoot in Australia. In this case, Gemini films used Mr. Santhanam’s services in Australia and promised him to pay his money after their arrival back into India. After the return to India, Gemini films sold the movie to Vishal Film Factory.

To the shock and surprise of Mr Santhanam, Vishal Film Factory refused to pay him his money and completely ignored him. Mr Santhanam contacted Gemini Films and Actor Vishal several times, however he was threatened with dire consequences. Mr Santhanam vexed in this situation and after consulting his legal consultant Ms. Savitha Kesav Jagadeesan, Partner in“Kochhar & Co” decided to fly to Chennai and file a case against Gemini Films.

On 5th September, Senior Counsel Mr. Sundaresan appearing for Kochhar & Co, argued Mr. Santhanam’s case along with J Sivanandaraaj Senior Partner Kochhar & Co., before Justice Sudhakar in the High of Chennai. Kochhar & Co argued that the movie titled "MADHA GAJAA RAJA" is being released by the Defendants without settling dues to their client for the expenses spent on eight day schedule shoot at Australia and substantiated their claim by producing documents. The Defendant No.1, Gemini Film Circuit mentioned that they have settled the dues with one Rasi Travels (P) Ltd., and hence there was no due. The Counsel for the Defendant No.4, Actor Vishal argued that he had purchased the movie from Defendant No.1 and had also obtained censorship certificate from CBFC. Further, CBFC had issued certificate only after accepting "NO DUE" issued by the creditors. After hearing the arguments, the Hon'ble Judge did not accept the contention of the Defendants and further directed the Defendants to deposit the suit claim amount before the Court and release the picture. The defendant Counsel for D 1,2 &3 was not inclined to deposit the amount before the Court. The Counsel for Defendant No.4 refused to give any undertaking. Hence, the Hon'ble Judge granted an injunction directing the Defendants to not to release the movie till 10.09.2013 and directed the Defendants to file a counter.
